He is breaking the law!
Your property is your property. The law requires that anything found needs to be turned into the Sheriffs or local authority's administration office. If the authorities do not locate or are contacted by the owner within 90 days, then the property is available for the person who found it to become their personal property.
We just dealt with this via the Hood River Sheriffs office, and they were very clear about this law.
Do not be ripped off by someone ransoming you, it is against the law.
A reward is for someone who does something courteous or of valiant behavior.
Contact the closest local authority. Prove your ownership either by description, witness, bystander, or shop receipt (call your shop if you lost your receipt).

Maritime salvage law does not apply, and even if it did peril must be proved. The ship in question MUST be at peril. A kiteboard is never at peril of sinking or imminent destruction. Even if it goes through the dam, damage is unlikely. So, even under maritine salvage law, the finder is NOT the owner. State law applies.
Now, if the trash had followed state law, he probably would have owned the board. Who reads the Notices in the paper? Or calls the Sheriff in every county his board may have drifted through? But he's shown he knows who the legal owner is, so he is legally bound to return the property on request. |

Tricky situation though... if the guy with the board gets scared, he may just ditch it and say it was all a mistake and he never had the board... I've been in the situation where I've known that people have stolen property, and the cops know it too, but don't have enough to get a warrant and so if the person just says "no, I don't have it" there's not a lot the cops can do.
If its not too late I would ask the guy what he wants for the board, agree to it, but agree to meet in a public place, and when he shows up with the board, just either take it from him, or pull out your cell phone and say you've got the cops on the line and they'll be right there if he doesn't hand over the board. Not an easy situation to remedy though. |

There's a simple solution to this problem. First you negotiate a ransom, even if it is full price. Don't sound to anxios and give him lots of reasons why you are so willing to pay to ge your board back. Like " it is my favorite board" or " it was an aniversery present from my wife" or " I bought it with the life insurance settlement money my grand mother left me after she was mauled by her poodle" you get the picture you really have to sell it. Next agree on a secluded place to make the exchange.
As soon as you have a visual on the board and you are sure it is yours, Size up the guy and decide " Can I take him ?" If he's the size of an NFL line backer, you may need a base ball bat for the next step.
This is the part where you teach the guy that holding a kiters board ransom is hazardous to you health. get creative with this step, it can be a lot of fun.
After convincing him that he would rather be a kook in the line up at Santa Cruz than ever mess with a kiteboarder again, politly offer him a six pack for the trouble of returning your board safely.
Funny how a little violence solves so many of lifes little problems. |

No kidding. No more bills, grocery shopping, buying gas, junk mail, etc... Just sitting around in jail with not a care in the world.
I'm sure your post was a joke, but you do know that if violence did ensue that you could be sued by the victim? Depending on the severity of injuries, you could lose just about everything. Not to mention criminal charges. One guy encourages another to assault a third party, said assailant engages in the attack. A compelling argument could be made for criminal conspiracy charges. Even if you got off with a good lawyer, do you have any idea how much that would cost? Just saying... Freedom of speech has bounds, encouraging criminal behavior is out of those bounds and not protected. |
