Thu Feb 25, 10 8:46 am OT: Family Law attorney referral, Salem/Eugene/Portland |
|
|
trying to help out a friend as referrals are always better than blindly choosing someone out of the yellow pages. NW crew is a great resource and was wondering if anybody had any experience with a kick ass family law attorney that they feel confident on referring who can help with a child custody situation. Please pm me on nwkite.com
thx in advance.... _________________ Marina

Can you give a little more detail?
Are you saying that the attorney can be located in portland, Eugene or Salem? Generally speaking you are going to want to hire someone locally, because otherwise you have to pay for travel time when there is a court appearance. And if you need to meet face to face that would require travel.
Also, are you looking for some one on the low end of the pay spectrum? High end? Doesn't matter - you just want a good lawyer? _________________ Still rockin gojos, *ssless chaps, and ankle weights! |

what is the age of the daughter? I can tell you two things about oregon family law.
1. Kid under 3 years old... No chance in hell of father getting full physical custody unless the mother is an addict or criminal.
2. Oregon will not mandate joint legal custody unless both parties agree. |

Don't know how you feel about bar complaints - but if your current attorney is an idiot you may want to file a bar complaint - it goes on his/her record - which gives other people warning.
Many idiot attorneys are idiots because they don't take the necessary time to do the job right - bar complaints help them get their priorities straight. _________________ Still rockin gojos, *ssless chaps, and ankle weights! |

If not then I doubt it'll have much impact. If the Mother murders her daughter, then your friend will have a pretty good chance. Not a sure thing though. Sucks, but true. Unless things have changed dramatically in Oregon over the last decade... |

Yep,
Divorce court is not designed for men.
Let that be a lesson to all of you young single men. Choose wisely or pay dearly.
I did the math and marriage was way more expensive than the divorce. I could have had a full time cook, maid and hooker for what my ex cost me during our marriage. It would have been a lot less hassle too.
Thank God for second chances. I chose well the second time. I could not be happier |

So did you go with Door #2 and get a full time cook, maid and hooker? _________________ Still rockin gojos, *ssless chaps, and ankle weights! |

Fairly recent case law in Oregon put the burdon of proof on the individual that wanted the change. This was a dramatic shift and burdon of proof is everything in court.
In my case, my ex had to PROVE that it was in our sons best interest that she move to the east coast. Prior to that decision (which occurrd 5 days before my trial) I would have had to prove that it was in his best interest NOT to move. My super lawyer showed up the day of court citing the new case law. My ex's attorney had no clue about the recent case but knew they had no chance... We settled out that day with all my conditions met. Best 12k ever.
Back to your case.. 5yo living with mom now and she got a DUI.... Your friend should save his money..you gotta a no chance unless their is a serious pattern of reckless or dangerous neglect. A single DUI not going to cut it. |

For three years I went through this and the court room is not meant for Dads. That said my attorney convinced a judge that was crazy for mother and thought her and her new husband were great and they made a lot of money and on and on, no DUI involved, and in the end I was given custody of my now 5 year old son! I cannot recommend any one more then I do Laura Rackner she is the best in town and as it turns out one of the best anywhere. Gearing, Rackner & Engel 503-222-9116
Feel free to pm me if you would like any more info. |

Viento, if I may ask, what were the big deciding factors that allowed you to get custody? I may attempt to get physical custody in the future. |

Gearing, and Rackner are awsome! Ditched my pussy ass lawyer for them and it was a whole new ball game, Got everything I wanted. They both are kick ass. I did a ton of research before picking them. Best money I ever spent. Well worth it. When my ex;s attorney found out I had switched to Gearing he told her to just give me what I wanted cause they would lose in court!! How awsome is that! She was all ready to fight me in court with my old attorney, so glad I switched before court. _________________ *AIR PIRATES KITEBOARDING*
