To whom this may concern:

This email is to express deep concern for the safety of bystanders and river recreations at Rooster Rock State Park in Oregon. As an annual pass holder/ visitor of Oregon State Parks for the last ten years or so, I have witnessed an every increasing degree of very dangerous activities involving kiteboarding at several Oregon State Parks along the Columbia River and Newport(South Beach) or Pistol River at the Coast. Of particular concern was a very recent situation at Rooster Rock on Sept. 29th, 2008 where a frequent visitor could have been killed by a kiteboarder nearly landing on him from a distance of which appears to be in excess of a 100 feet of airborne flight.

One incident has actually been documented on a pubic forum as positive and rewarding experience in which a kiteboarder claimed he almost killed a windsurfer. As of this Sunday, October 5th, 2008 it was available on the Internet by 9am, however, I don't know if it will be available by the time the appropriate Oregon State Parks personnel can evaluate this matter themselves. In the event it isn't available, I have filmed the video clips and posting from the Internet. This matter of safety concerns was verbally addressed to a female ranger at Rooster Rock State Park around 5:30 on Sept 29th, 2008. This cordial conversation of perhaps 5 minutes between the two of us ended when she expressed needing to visit the bank before closing by 6pm that evening. Neither myself nor this polite ranger understand who may be responsible for the safety concerns involved.

In speaking with Mr. Kevin Price at Rooster Rock briefly over the years, he has mentioned the Rooster Rock has no enforcement of any actions at the beach part of the park or once in the Columbia River. Perhaps it lies entirely within the boundaries of the Columbia River itself or something else, but this park does indeed have roped off swimming areas from time to time and certainly posts enforces no dogs on the beach. My statement to the state parks officials is that it would seem possible that some degree of safety regulation could be mitigated that Kiteboards at a minimum be asked to stay within some boundaries and guidelines. This is only a safety matter between the kite boarders and other users of Oregon State Parks.

I welcome any opportunities to discuss this safety matter with you in greater detail. Thank you in advance of this consideration.

As we've discussed in the past, safety is paramount, as it relates to any recreational activity which occurs in a state park. We will continue to try and monitor and correct any unsafe conditions.

As you noted, state parks employees only have jurisdiction on state park properties (not the Columbia River).

Patient people and persons in authority

I'm sure there will be some attention paid to this
on the part of the authorities

all it takes is one patient complainer and
the obvious danger to the public

who's not stupid,
he's the dude I spoke with on the jetty,about the Rooster incident
a long time PDX /Flo/Pistol windsurfer/kayaker
A beach goer mentioned the incident at S.Beach
she was an observer at the surf event
bad news travels 10 times faster than good it would seem

What I know about John W.
several years ago he announced to the kiters present at the S.Jetty
that we had to stay 2 kite lengths from him after a run in with a kiter the day before in the Gorge, something about strings around his neck is where I came in,well this would not pass with our local P/A he took it to argue with him which went on for the whole time I rigged and some heated words were thrown,
skip to the next time our kite pal was there by himself and loses his board
John nabs it and won't give it back until some deal is struck!
which I don't care about
currentlly a peace exists with him and all the windsurfers and respect is given on all sides
John has a trainer kite and endeavors to make friends
I told him I also keep an eye on people who I don't know,
but a unpredicable dude for sure and not likely to be intimidated
or looking over his shoulder much before he would say something and be willing to back up evey bit of it.
I grew to like him a lot more after I heard the story of how some RV er's parked at Pistol and let thier dog shit in the parking area in front of everybody and wouldn't pick it up.He said some thing to them and they went inside and grabbed a bag and picked it up.
Only to throw it back out as soon as they left ,Well John can run pretty fast as well and picked it up and threw it on thier windshield ,the brakes went on the battle ensued
I don't really care obout the outcome of that either

blowhard, at the rufus incident you forgot to mention he verbally berated his girlfriend in front of the peanut gallery (she was sticking up for him which made it all the more hilarious) and made her cry. although the kiter in question was 100% at fault during the incident whaley's reaction goes down as one of my all time favorite kiting experiences...

I'll speak with Jim and the CGKA board about setting up a line of communications with Oregon State Parks to follow up on this letter of complaint.

I have known Kevin Price as a fellow member of the CGWA Board of Directors for a number of years. He is a fair and even minded individual who will tend to research all details before taking any actions on a situation if he is unfamiliar. He has been a very supportive advocate of both windsurfing and kiteboarding at Rooster Rock for a long time.

Blowhard, much respect given to you, however the picture being painted here of Mr. Whaley is not one of someone I'd respect. Just because he can get another girlfriend is not an excuse to berate the one with him to the point of tears. He sounds like a bully and a control freak to me. He wasn't even at Rooster Rock when the incident in question occurred. He conveniently leaves out the detail that apologies were made and accepted. As far as the board he took, It's really too bad that the kiter in question didn't call the police and have him arrested for theft and blackmail. If what is stated on this thread is accurate, then he is a pathetic asshole. I care not one whit that he is "big and fit". I stopped being afraid of bullies in the third grade. Mr. Whaley, if you are reading this, I apologize if the description of you here is misleading. If it is not then I stand by my statement. As far as your email, why not whine about situations that actually affect you, rather than present this one out of context to further your own agenda?
