This is an interesting topic and I'm just stoked WA is leading the charge in progressive change...even if it's not perfect...yet.

Here's what I've learned so far in regards to the DUI part:

I-502 mandates that anyone caught driving with a specific level of active THC in their blood – 5 nanograms per milliliter – would be presumed to be driving under the influence. THC is the chemical in marijuana that makes users high; proponents compare the rule to the .08 blood alcohol concentration limit set for drunk driving.

Unlike urine tests, blood tests detect the active presence of THC in the bloodstream. In the case of smoked marijuana, THC peaks rapidly in the first few minutes after inhaling, often to levels above 100 ng/ml in blood plasma. It then declines quickly to single-digit levels within an hour. High THC levels are therefore a good indication that the subject has smoked marijuana recently. THC can remain at low but detectable levels of 1-2 ng/ml for 8 hours or more without any measurable signs of impairment in one-time users. In chronic users, detectable amounts of blood THC can persist for days. In one study of chronic users, residual THC was detected for 24 to 48 hours or longer at levels of 0.5 - 3.2 ng/ml in whole blood (1.0 - 6.4 ng/ml in serum)

...It seems where this will need to be adjusted first would be for medical users. Under the current law they are not protected/exempted and the limits are somewhat arbitrary or over generalized.

This is a good thing IMO, although close friends and family of mine will strongly disagree with me. If anything, it's about signaling overdue change in the right direction. From the states and municipalities upward. I'm sure I'll learn more as this progresses however.

a give the dui more teeth law

and a tax law

and a law to establish rules for producers, processsors(middlemen), and retailors

I read it, and it is really long and boring

Now I got to figure out what 5.0 THC in my blood feels like Shocked

The medical law is more than adequate. Anyone could qualify, and if your were to lazy to take advantage of that shame on you. Now we get a well defined impossible to beat dui law and 83%+ tax on what was a tax free product.

Sorry to hijack your post but this law really ticked me off. People just see, hey I can smoke weed woohoo, without realizing the freedoms they gave away for it. When all along all they had to do was pay a friendly doctor a 100 bucks and get it tax free without a well defined dui burn

Another supporting point to legalization is hopefully we might weaken the absolute power of the Zetas, and Sinaloa cartels.
Getting pulled over stoned is a joke. I was never safer than the stoned years (my 20's) when I was high. It's a miracle I didn't get pulled over for going 12 in a 25. But then again, maybe folks aren't all paranoid like we all were back then?

Yea, sorry, I might have jumped to my own conclusions there.

You raise some very valid points about the DUI possibilities, pretty scary how close it is.

I think it is mostly right on, but the huge issue it misses are the effects of the "war on drugs".

People should not be going to jail for possessing pot, and I think this is the most positive effect of the new laws.

I can't believe people are publicly whining that they can't drive stoned now. I doubt you will find much sympathy.

The whole thing about this is now going to be challenged federally. If the Federal Courts stick the whole state law can't supersede a federal law it may take away even Medical use.

The Mexican Governement is already complaining about effects it will have on the Cartels... The are stating that is will cut profits from something like 6.0 billion to 4.7 billon.

Complaining? Ha, legalize it for JUST that one reason... Yeah, come on... getting stoned and just not moving is a better deal anyway...

Kool , anybody have a donut or an extra soda , my mouths soooo dry and I like a sugar rush before I kite too !

Medical Marijuana ,?, now I have more to laugh at .
I can smoke the shit outta some fine bud and my back still hurts . It still hurt when I had to put my best friend ( dog ) down . My car had a flat tire and I was late for work , it pissed me off , And , I was high . Medical Marijuana my ass . Just come right out and be honest .

That was funny jack!!!

A long long time ago when I was 16 years old, my parents allowed me and my 4 siblings to grow our own. This was when pot was sold in "lids" and we measured the quantity bought and sold by how many fingers were used to measure the width of a sandwich bag full of the stuff (aka "rag weed"). A five finger lid was big and about $25 for the good stuff. We could not have imagine it would ever be measured in grams.The premium brand was called Columbia Gold. Then Thai Stick came along as an exotic smoke. Does this bring back memories anyone?

Everyone has a different reaction. Early on I realized it just made me stupid, so never strove to developed the horticultural skills of my siblings. I dont know if it was our early access, but, none of my siblings have any interest today.

Love the early days reminiscing. That old story really makes me old.

We moved to Nebraska from the east coast when I was young and dinosaurs ruled the earth.I knew that weed grew wild there, and I also remember wondering how we would deal with the wild Indians,(we were moving to Fort Omaha).

So in the wee hours one summer noche, I sneak out in my dad's new cadillac, go tearing around back roads until I find a field 12 feet tall, cut down a couple with my trusty boy scout hatchet, and dry it out in our cellar.(which still had the attachments for leg irons and stalls for the officers horses.)

Rolled it up in the yellow pages, and puffed down that big ol' cheech and chong joint.

Kinda got a headache, and it didn't feel like much. I remember wondering what all the fuss was about.

So I find out much later that it was nettles, which in the midwst grows huge and kinda looks like the picture of marijuana in the encyclopedia britannica.

No wonder my arms were so itchy that week.

So keep it outta the hands of kids(which the above story tends to prove that kids generally have no clue, and will do everthing and anything regardless of the consequences)

And quit putting adults in jail for something thats about as harmless as can be, and exacts virtually zero toll on society.

No victim, no harm. No crime.

I served in the military, fought in a war, and supported my inefficent wasteful, and in some regards corrupted government (don't get me started on lobbyists, big oil, and good ol' boy govt, no really, don't!)by paying taxes my entire adult life.

The point being, Good on ya, Washington, (and Colorado, yayyyyy!) for recognizing that good people aren't criminals, cause criminals hurt people.

And smoking weed doesn't.

All marijuana possession and sale remains illegal under federal law, and Seattle Police cannot predict or control the enforcement activities of federal authorities.

Can I legally carry around an ounce of marijuana?

According to the recently passed initiative, beginning December 6th, adults over the age of 21 will be able to carry up to an ounce of marijuana for personal use. Please note that the initiative says it “is unlawful to open a package containing marijuana…in view of the general public,” so there’s that. Also, you probably shouldn’t bring pot with you to the federal courthouse (or any other federal property).

Well, where can I legally buy pot, then?

The Washington State Liquor Control Board is working to establish guidelines for the sale and distribution of marijuana. The WSLCB has until December 1, 2013 to finalize those rules. In the meantime, production and distribution of non-medical marijuana remains illegal.

Does I-502 affect current medical marijuana laws?

No, medical marijuana laws in Washington remain the same as they were before I-502 passed.

Can I grow marijuana in my home and sell it to my friends, family, and co-workers?

Not right now. In the future, under state law, you may be able to get a license to grow or sell marijuana.

Can I smoke pot outside my home? Like at a park, magic show, or the Bite of Seattle?

Much like having an open container of alcohol in public, doing so could result in a civil infraction—like a ticket—but not arrest. You can certainly use marijuana in the privacy of your own home. Additionally, if smoking a cigarette isn’t allowed where you are (say, inside an apartment building or flammable chemical factory), smoking marijuana isn’t allowed there either.

Will police officers be able to smoke marijuana?

As of right now, no. This is still a very complicated issue.

If I apply for a job at the Seattle Police Department, will past (or current) marijuana use be held against me? The current standard for applicants is that they have not used marijuana in the previous three years. In light of I-502, the department will consult with the City Attorney and the State Attorney General to see if and how that standard may be revised.

What happens if I get pulled over and an officer thinks I’ve been smoking pot?

If an officer believes you’re driving under the influence of anything, they will conduct a field sobriety test and may consult with a drug recognition expert. If officers establish probable cause, they will bring you to a precinct and ask your permission to draw your blood for testing. If officers have reason to believe you’re under the influence of something, they can get a warrant for a blood draw from a judge. If you’re in a serious accident, then a blood draw will be mandatory.

What happens if I get pulled over and I’m sober, but an officer or his K9 buddy smells the ounce of Super Skunk I’ve got in my trunk?

Under state law, officers have to develop probable cause to search a closed or locked container. Each case stands on its own, but the smell of pot alone will not be reason to search a vehicle. If officers have information that you’re trafficking, producing or delivering marijuana in violation of state law, they can get a warrant to search your vehicle.

SPD seized a bunch of my marijuana before I-502 passed. Can I have it back?

No.

Will SPD assist federal law enforcement in investigations of marijuana users or marijuana-related businesses, that are allowed under I-502?

No. Officers and detectives will not participate in an investigation of anything that’s not prohibited by state law.

December 6th seems like a really long ways away. What happens if I get caught with marijuana before then? Hold your breath. Your case will be processed under current state law. However, there is already a city ordinance making marijuana enforcement the lowest law enforcement priority.

I’m under 21. What happens if I get caught smoking pot?

It’s a violation of state law. It may referred to prosecutors, just like if you were a minor in possession of alcohol.
