Out of interest, I just looked up Oregon's laws on fog lights. A pretty simple Google search. The law is pretty clear on how and when to use them. Although a bullshit ticket, and most likely an attempt to cite you for something else, the officer is correct about the fog lights. The question is, "How do you handle it from here?" You'll most likely get the ticket reduced by showing up to court and taking responsibility for not understanding the correct usage. |

sounds like a raw deal but lots of good feedback.
I highly doubt the bike carrier mfgs would create a product like the hitch mount for who knows how many years to find out now how it is unlawful to use.
I def would go to court on this one.
in the future I would like to hire nak as my legal counsel!

oregon driver manual booklet states-
Fog Lights
A vehicle may be equipped with fog lights. The lights may be white or
amber and the beam must strike the road not more than 75 feet ahead of
the vehicle on which it is mounted. These lights are to be used in the same
manner as high beam headlights. _________________ www.jimstringfellow.com |

I was pulled over about a month ago by a stater on my way down from a cruddy day at meadows. It was foggy and icy. I received two citations totaling $450 for silly reasons

Obstruction of license plate

Cop clearly sounds like he was being a dik, but, is there part of the story we're not hearing?
Did he pull you over for something else, didn't find evidence of it, and then just hit you for these items instead? Were you rude to him? Did the car reek of alcohol or reefer or something?
Either way the citations are BS! I was just wondering what pissed him off. I agree, if he pulled you over for just these things than he must be a rookie or was annoyed at somebody else who told him to go write some tickets... |

There really isn't much of a story. I'm basically a square (engineer-type): no drugs or roadies goin' on. Everyone in my car was bone-sober. I drive 25 MPH everywhere in town because the cops here are a bit too ambitious about citations.
When he pulled me over, he asked me if I had any idea why he did. I said no. Then he said that my fog lights were on and that my rack what blocking my plate. I asked him for an explanation of the codes. He said sure and took my papers and left. He returned to my car after about twenty minutes with the citation and sarcastically told me that I could look up the codes online. At that point (after he gave me the $ 450 citation), I gave him an earful and told him he was out-of-line. I filed a complaint about the a$$hole but it didn't go anywhere.
No hidden story. That's why I'm pissed. |

I got the fog light pull over during a nasty late night rain storm on I-84 by Mosier. I didn't realize at the time it was an actual law and told the stater...."Well you're going to have a long night because here comes another car with fogs on...and another one....and another one...etc. While he was checking my drivers license I was yelling out the window..."AND THERE GOES ANOTHER LAW BREAKER TRYING TO GET HOME SAFELY!"
No ticket so I figured if it's a first time offense it's a warning only situation so pretty lame Logik got a ticket.

Was doing some research on the license plate thing. In my opinion, this one isn't as cut and dry as the fog lights. The law wants your plates to be lit and clearly visible. It specifically forbids putting clear or semi-clear covers on the plates. But, what is clearly visible?
A really dirty car doesn't have clearly visible plates.
My truck, when pulling a trailer, doesn't have clearly visible plates.
A car using a tie down strap to keep the trunk closed when that strap goes to the bumper, may not have clearly visible plates.
The law seems to address car alterations. In this case, you were never intending to alter your car. You might have room to argue on this one.

Your ticket should reference the exact law you broke. |

People put the clear/semi clear covers over license plates to defeat photo radar traps. When they take your photo they dont get a clear shot of your license plate number, so they cant give you a ticket. I think.... _________________ 1 OF 1 |

Nak, do you know of any localish bike organizations that would be bothered by this?? Contacts perhaps?? This is the citation that is problematic due to the precedent that it could establish. I think your idea here is great. Specific info on bike organizations would be useful. |
I'm not a member of any bike organizations, but I'm sure there are several at least. I found this which is similar to your case: http://mobikefed.org/FightTheBikeRackTicket
I would imagine the makers of hitch mounted accessories would want to help you, even to the extent of hiring a lawyer for you. Tickets like this one could literally put them out of business. Start by contacting the maker of your bike rack. Try and talk to someone with some clout. The customer service agent you first talk to might not be able to understand the impact to the company, but one of the higher ups should be scared shitless by this ticket. It is in their critical self interest to see you beat it. Pleading guilty to get a lower fine sets a dangerous precedent; they'll want the thing dropped completely or beaten in court.

BS. LOL, I know a few State Police, good guys. And I promise you, you never picked on them at any time in your life. The mere thought of it is hilarious to contemplate. Sorry, no offense, but very true.
State cops are just like everyone else. There are assholes and there are good guys.
You gotta remember, it isn't these guys fault they primarily run traffic patrol and give tickets. That fault lies with the politicians who see traffic tickets as a revenue source. It's your fault and my fault for not actively supporting candidates for State office who are dedicated to changing things. It's our fault.
99% of these State Troopers will lay their life on the line without hesitation to save your ass. That should earn them a bit of respect. |
