Just in case your are interested....

Four of us were enjoying the flat water tonight. About 7 PM I noticed a state trooper hanging out at the high water launch area. One of us was coming in and talked with him for a while. Later this kiter told me the trooper was just shooting the breeze...no talk about crossing.

Later we were packing up. Two of us went across the Klickitat River to cross there. One went up the regular way and got nabbed. We didn't stick around to find out the damages. I believe he is the son of the guy who drives that triangular electric car. I think he lives in Lyle. If someone knows his name I can call him? PM me.

Has anyone ever actually tried to walk/crawl under that RR bridge?

Has anyone ever posted that they have gotten a ticket? Rumors suck.

i just had a :drunk brainstorm Arrow if i borrow a large roto hammer/chip gun from work and some one lends use of generater power for the day i could chip a goat path in i'm gonna say 4 hours.

Only problem with altering the bridge is that the goverment could consider it an act of terrorisim since it could possibly alter the structural integrity of the bridge. I think I would rather the $1000 ticket Shocked

I read a real interesting post on the Ikitesurf form a few weeks ago. A California resident posted that in the States by laws that no railroad can block access to any waterfront. Not the exact quote but you get the idea. Anyways it seems like some (dare I say it) logical thinking.

Just found it:

CALIFORNIA CONSTITUTION
ARTICLE 10 WATER


SEC. 4. No individual, partnership, or corporation, claiming or
possessing the frontage or tidal lands of a harbor, bay, inlet,
estuary, or other navigable water in this State, shall be permitted
to exclude the right of way to such water whenever it is required for
any public purpose, nor to destroy or obstruct the free navigation
of such water; and the Legislature shall enact such laws as will give
the most liberal construction to this provision, so that access to
the navigable waters of this State shall be always attainable for the
people thereof.

Why is this only in Californias constitution and not the rest of the US. Evil or Very Mad Question

You would have a hard time proving that kiteboarding is a REQUIRED use of the waterway.

No, but it's not hard to prove that the access to the Lyle spit has been a necessity for about 75 years for some people. At least that's what our latest thinking is.

"for any public purpose" includes kiteboarding, sport fishing, tourism...

I am surprised neither WA or OR has a similar law.

You got one too, huh? (although in the interest of disclosure, mine didn't contain any f-bombs) Apparently, BNSF can't tell just by showing up at "the spot" and looking at the sky whether or not people are kiting there and has to resort to patrolling nwkite... Rolling Eyes

I think it's time people start thinking about Kayaks...

I got a chance to speak with Jonah's friend who is a lawyer that's dealt in similar situations. We're going to be meeting soon to formulate a plan of attack to get a crossing built. I know we have a lot of people here that are enthusiastic about moving this forward and I'm going to need your help. The majority of this work will probably be done in the non-windy part of the year. Just keep this in the back of your mind and have a little faith cause it's going to be a few years to make this happen.

There are lot of people that read this forum that's why we have to be careful what we say. For example...the Mayor of HR, The Port of HR, The Port of Stevie, CGWA, ect...I wouldn't be suprised if someone from the BNSF was checking it out too.

Instead of wasting energy going back and forth between each other. We should put that energy into helping Forrest get Lyle reopen
