I heard this morning on the radio a warning issued to kiters for crossing the railroad tracks at da spot -- 1000.00 ticket is waiting for those who cross.

Did the announcement refer to just kiters?

Not fishermen, local kids, wandering tourists...

specifically called out kiters but also said anyone who crosses the tracks... it was on 105.5?

Sounds like it may be done out there. Evil or Very Mad

Dudes, people are like cows....if you don't have a fence in place - they're just gonna go everywhere they want...ohhh, and just like cows, there are also some people out there that cann't read shit...so a sign is useless...

1000.00 fine is Bullshit if you ask me....
Hell - it takes less than that to put up a portion of fence and a gate (including labor)....

I'm with chooch on this one....how about other alternatives, like a boat or a raft...

Remember, just because it's illegal to cross the tracks, doesn't mean it's illegal to kite down below on the sandbar....

Its time for a mass peaceful civil disobedience demonstration.

We can organize a group of 100+ kiters, dog walkers, fishermen and locals to cross the tracks in an orderly and peaceful manner and all get a ticket. There's no way the courts will let this stand (I hope) and issue us all $1000 tickets.

We'll probably want to wait till there's actually a sand bar to cross to so we have a point to make.

I'm in. How about this weekend if the water is down low enough??

It would have to be done carefully and with enough of a 'nudge' in the right spot to get the help we need.

If the demonstrations shut down the tracks it would cost the r.r. a shit ton of money and that could play badly for the kiting community.

I think one of the best option is suspended bridge anchored into the rock cliff underneath the bridges. This can be done with climbing anchors and cables...

I doubt the police would issue 100+ tickets but they would probably issue arrests to the organizers if the police knew about the march in advance. Alternatively, the police may just ignore the march and pick off individuals for tickets in the subsequent weeks should anybody try it.

Last couple times I've been out there, I've seen somebody blocking the access drive, on one occasion it was a kiter's truck. I don't imagine that helps. How hard it is to just park in the damn lot across the road??? Shitty.

Hear hear. Why ruin it for everyone? When I was there last I think it was a shop grom and his girlfriends parked there. What makes you special??

The question is, where does the RR land start? Really, they have the right to protect their own land from liability, though I do call BS on singling out kiters. I watched several local kids playing on the tracks and fishermen walking down the middle of it; we just go from point A to B. Maybe a protest on adjacent public land with signs, enough to make the train engineers nervous but technically not violating any law?

Or the zodiac taxi sounds good...

Not a lawyer, but I have heard of legal precedent where if a law is not applied unilaterally to all people without bias, then it is struck down in court. Anyone else heard of this? It might have been under the context of racial profiling, but kiters are a race, right?? Wink

That sound byte could come in handy in court (esp if made by an RR rep or enforcement agency). Anyone capture it?

This is true. When it comes right down to it, I could totally understand their argument, were it not for the singling out of kiters. Parking on the access drive notwithstanding, we pose less of a liability threat than anybody, the way I see it. We lay low, wait for the train to go by, get across fast, and generally aren't shitfaced while doing it. I have to think there's a solution to this that doesn't involve skis or zodiacs, though. Zipline? Tunnel? Rope bridge? Trebuchet? Those Slider Project guys know how to get shit done, we should put them on this... although I suppose they deserve a break for the time being.
