They way I read this, the legality of the Port allowing Naito to build a cable park could go either way. But, public support for the cable park could be seen as the public wanting to use the water, which would influence the court's decision.

can you please clarify; why is this situation different than someone building a marina or a floating house community? these exist on the Columbia and the Willamette today. seems a precedent has been set. or is everything we see today on the rivers grandfathered in before laws were passed?
